The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 354, 328, 307, 504/34 of the Indian Penal Code.

The prosecution case as per F.I.R is that the informant had solemnized love marriage with one Raj Kishore (elder son of petitioner No. 1). It is further alleged that after few days of marriage the petitioners started abusing her and on 12.06.2021 the petitioners

Patna High Court CR. MISC. No.68270 of 2021(3) dt.27-09-2022 2/3 attempted to administer poison to the informant. After hearing the noise, the husband of the informant came and took her to hospital.

It is submitted by learned counsel for the petitioners that petitioners have falsely been implicated in this case by the informant with a view to get her husband's share of land transferred to her name. It is further submitted that whenever a Medico-Legal Case comes to hospital then the hospital authority itself inform the local police station prior to starting the treatment but no such things has been happened in this case, which itself goes to show that with some ulterior motive this false case has been registered against the petitioners. A statement has been made in para 3 of the petition that petitioners have no criminal antecedent. Learned APP appearing on behalf of the State has vehemently opposed the prayer for anticipatory bail of the petitioners.

In the facts and circumstance of the case, let

No.68270 of 2021(3) dt.27-09-2022 3/3 the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate IX, Bhagalpur in connection with Lodipur P.S. Case No. 113 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
