Heard learned counsel for the petitioner, learned counsel for the informant and learned Additional Public Prosecutor for the State. Earlier twice the petitioner was ordered to be released on bail respectively vide orders dated 6th March, 2013 and 10th January, 2014 passed in Cr. Misc. Nos. 39621 of 2012 and 45740 of 2013 but for some reasons explained in the order dated 27th May, 2014 he could not be released by the court below.
It is pointed out that in the two cases, i.e., (i) Begusarai Town P.S. Case No. 60 of 2003 and (ii) Begusarai Town P.S. Case No. 99 of 2007 he was and he is on bail, of course, under some confusion, as stated, vide order dated 28th April, 2014 his bail-bond was cancelled in Begusarai Town P.S. Case No. 99 of 2007 but ultimately such order has been recalled. In that view of the matter, there appears no reason for further detention of the petitioner in present case. Patna High Court Cr.Misc. No.45341 of 2014 (3) dt.07-01-2015 2/2 named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Sanjeev Kumar-1st, Judicial Magistrate, Begusarai, in connection with Begusarai P.S. Case No. 161 of 2012, subject to condition to remain physically present before the court below on each and every date till disposal of the case and in case of failure on two consecutive dates without giving any reasonable explanation, the privilege granted shall be deemed to be cancelled.
