The petitioner apprehends his arrest in Taraiya P.S. Case No. 295/2016, registered for the offences punishable under Sections 272, 273, 295 and 34 of the Indian Penal Code and Sections 30(a), 38 and 41 of the Excise Act.

The informant alleged that the villagers of Galiyapur village informed that somebody kept drum of country made liquor in the graveyard. The informant reached there and recovered the drum from the graveyard. It is further alleged that the villagers disclosed that Ajay Manjhi, Suresh Rai and Preetam Rai are indulged in selling of country made liquor.

Learned counsel for the petitioner submits that nothing has been recovered from possession of the petitioner.

Considering the facts aforesaid, the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 9th, Saran at Chapra in connection with Taraiya P.S. Case No. 295/2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
