The petitioner being the elder brother of the husband of the informant is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 498A, 307/34 of the Indian Penal Code. The prosecution case is of inflicting torture and making assault to the informant. It is further alleged that informant received one marginal size abrasion injury on the right and left upper part of back It is submitted by the learned counsel for the petitioner that petitioner claims to be separate from the husband of the informant.

It is submitted by the learned counsel for the informant that there is specific accusation of assault

Patna High Court Cr.Misc. No.45579 of 2016 (2) dt.19-10-2016 against the petitioner.

Considering the nature of accusation, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Bhabua (Kaimur) in connection with Bhagwanpur P.S. Case No. 141 of 2016, subject to conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) P.K./- U T
