====================================================== CORAM: HONOURABLE MR. JUSTICE AHSANUDDIN AMANULLAH ORAL JUDGMENT Date : 10-12-2018 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends arrest in connection with Korma P.S. Case No. 05 of 2018 dated 04.02.2018 instituted under Sections 420/406/409/469/468 and 120B of the Indian Penal Code.

3. The petitioner was the Manager of Katari PACS and a controversy arose that he had not deposited Rs. 50,000/- in the account of the PACS and with interest the same would be about Rs. 1,50,000/-. On the basis of the complaint filed, Korma P.S. Case No. 05 of 2018 was instituted.

4. Learned counsel for the petitioner submitted that without going into the merits, as per the figure given by the Katari PACS itself, a sum of Rs. 49,655/- has been deposited in its

Patna High Court Cr.Misc. No.57875 of 2018 dt.10-12-2018 2/2 account, in support of which he has drawn the attention of this Court to Annexure-3, which is receipt of such deposit. It was further submitted that the petitioner has no criminal antecedent.

5. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Sheikhpura in Korma P.S. Case No. 05 of 2018, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973.
