The petitioners are apprehending their arrest in a case registered for the offence punishable under Sections 341, 323, 324, 307, 302 and 34 of the Indian Penal Code. Allegation against the petitioners is that they along with others co-accused persons assaulted the informant and his family members. One of the co-accused Raja Kumar assaulted the father of the informant by means of 'iron dab' due to which during the treatment father of the informant died. Learned counsel for the petitioners submits that the petitioners are innocent and have been falsely implicated in this

Patna High Court CR. MISC. No.57430 of 2022(2) dt.20-12-2022 2/2 case. He submits that there is specific allegation against the petitioners to assault the deceased. He further submits that injuries found upon the victims are simple in nature. He further submits that petitioners have no criminal antecedent as stated in para-3 of this application.

Learned APP for the State opposes the prayer for bail. Considering the facts and circumstances of the case, let the above named petitioners in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be enlarged on bail on furnishing bail bonds of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Runni Saidpur P.S. Case No. 204/2022, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
