JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-10-2016 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 447, 341, 323, 307, 504 and 379/34 of the Indian Penal Code. The prosecution case is that on 27.07.2016, the informant made protest for flowing water by the petitioners on the land of the informant then the petitioners assaulted the informant, his wife and son with lathi and iron rod and snatched gold chain from the wife of the informant.

It is submitted by the learned counsel for the petitioners that the petitioners are next door neighbour of the informant. The accusation has been levelled in the background of dispute with regard to flowing of waste water of hand pump. The petitioners'

Patna High Court Cr.Misc. No.45925 of 2016 (2) dt.22-10-2016 2/2 side lodged Complaint Case No. 4597 of 2016 against the informant's side though subsequent to the lodging of the present FIR. The injuries have been found to be superficial simple in nature. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent.

Considering the genesis of the occurrence, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Gopalganj in connection with Gopalganj P.S. Case No. 316 of 2016, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Amrendra/- U T
