====================================================== CORAM: HONOURABLE MR. JUSTICE DINESH KUMAR SINGH ORAL ORDER 27-10-2016 Heard learned counsels for the petitioner and the State.

The petitioner being the husband of the informant is languishing in custody since 11.07.2016 in a case registered for the offences punishable under Sections 341, 323, 498(A), 379, 495, 504/34 of the Indian Penal Code and 3/4 Dowry Prohibition Act.

Basis accusation is of torture for non-fulfillment of the dowry demand and the petitioner having illicit relationship with one Arti Devi. It is also alleged that informant was assaulted by the petitioner and other in-laws and her ornaments were snatched.

It is submitted by learned counsel that the petitioner

Patna High Court Cr.Misc. No.47183 of 2016 (2) dt.27-10-2016 2/2 admits his marriage with the informant and still ready to keep her with due dignity and honour, statement to that effect has been made in paragraph 10 of the petition which reads as follows:- "That the petitioner is always ready to keep his wife and child but informant is willing for conjugal life." Moreover, the investigation has already conducted. Considering the nature of accusation and the present stand of the petitioner, let the above named petitioner, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Ara Muffasil (Dhobha) P.S.
