JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-02-2020 Petitioner seeks bail in connection with Jehanabad Mahila P.S. Case No. 31 of 2019, registered for the offences punishable under Sections 365, 354B and 34 of the Indian Penal Code.
As per FIR the victim lady left her house due to altercation with her husband and came to Patna and taking advantage of her loneliness accused persons taken her to Jehanabad and they misbehaved with her and on alarm people assembled and accused persons were arrested.
Submission of learned counsel for the petitioner is that there is discrepancy between her initial statement and the statement under Section 164 Cr.P.C. and co-accused having similar allegation has been granted bail by a co-ordinate Bench of this Court by order dated 27.11.2019 passed in Cr.Misc.No.
Patna High Court CR. MISC. No.61961 of 2019(3) dt.06-02-2020 2/2 55070 of 2019 and he is in custody since 17.6.2019 and charge sheet has been submitted, as such there is no chance of tampering with the evidence.
Heard learned APP also.
Considering the submission made above, let the petitioner be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jehanabad, in connection with Jehanabad Mahila P.S. Case No. 31 of 2019.
