JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-10-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 411 of the Indian Penal Code and sections 25(1-B) a, 26 and 35 of the Arms Act. On raid being laid, one Avinash Kumar Upadhyaya was apprehended when petitioner and others managed to escape from the scene. From the possession of Avinash one country made pistol, two live cartridges and one TVS Apache motorcycle, suspected to be stolen one, were recovered.
It is submitted by the learned counsel for the petitioner that for the same occurrence two cases were lodged; one under section 392 IPC on the statement of the person whose motorcycle
Patna High Court Cr.Misc. No.39960 of 2015 (2) dt.05-10-2015 2/2 was robbed and the present case in which the petitioner has been roped in on the basis of the apprehended accused Avinash. It is further submitted that there is no recovery from the petitioner. Let the learned court below consider the prayer for regular bail of the petitioner in case the petitioner surrenders within six weeks from today in connection with Buxar Industrial P.S. Case No.125 of 2015 pending in the court of learned C.J.M. Buxar. This application is disposed of with the aforesaid observation/direction.
