The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 457 and 380 of the Indian Penal Code. The prosecution case is that when the informant was sleeping with the family members after the marriage of his younger brother on 07.06.2015 at 12.10 A.M. the accused persons entered into the house and took away jewellery and other articles. The brother of the informant made scuffle with petitioner no. 1 but he escaped from the scene.

Patna High Court Cr.Misc. No.39872 of 2015 (2) dt.05-10-2015 2/2 It is submitted by learned counsel for the petitioners that only on suspicion the accusation has been levelled and except petitioner no. 2 other petitioners have no criminal antecedent.

The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioners surrender before the learned court below within a period of six weeks from today in connection with Jagdishpur P.S. Case No. 97 of 2015 pending in the court of learned Chief Judicial Magistrate, Bhagalpur.

With the aforesaid observation, this application is disposed of.
