The petitioners apprehend their arrest in a case registered for the offence punishable under sections 419, 420, 467, 468, 471, 34 of the Indian Penal Code.

The allegation against the petitioners is that they in collusion with Kativ Devendra Kumar committed forgery in sale deed. It is submitted by learned counsel for the petitioners that petitioners are quite innocent and have committed no offence. They have been falsely implicated in this case. No such occurrence, in the manner as alleged, has ever taken place. The allegation levelled against the petitioners is not specific rather general and omnibus in nature. He further submits that from the perusal of the FIR, it is evident that the sale deed was executed by Late Rajendra Singh

Patna High Court CR. MISC. No.58131 of 2022(2) dt.03-01-2023 2/2 during his lifetime on 20.02.2016 in favour of petitioner no.1 of 89 decimal of land on payment of consideration money. Rajendra Singh died in year 2017 and thereafter his son-in-law filed the present case after a lapse of about six and a half years. The petitioners are own gotia of Rajendra Singh who executed the sale deed. Petitioners have no criminal antecedent.

Learned APP for the State as well as learned counsel for the informant opposed the prayer for anticipatory bail by submitting that the petitioners are also involved in the alleged forgery. Having regard to the facts and circumstances of the case, as there is a civil dispute between the parties, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in connection with Sheikhpura P.S. Case No.319 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
