JUSTICE SANJAY PRIYA ORAL ORDER 24-08-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in Chandradeep P.S. Case No. 46 of 2015 instituted for the offence under Section-273 of the Indian Penal Code and 47(A) of the Excise Act. It is alleged in the written report that 25 pouches of illicit country-made liquor have been recovered from wooden Gumti of the petitioner. The petitioner managed to run away on seeing the police party.

In such circumstances, there is specific allegation of recovery of illicit country-made liquor from wooden Gumti of the petitioner. Therefore, this court is not inclined to grant anticipatory bail to the petitioner. Accordingly, prayer for anticipatory bail is rejected. The petitioner is directed to surrender in the court below and seek regular bail which will be considered by the court below in accordance with law without being prejudiced by this order.
