JUSTICE ASHUTOSH KUMAR ORAL ORDER 10-12-2018 The petitioners seek bail in anticipation of their arrest in connection with Chousa P.S. Case No. 54 of 2018 instituted for the offences under Sections 341, 323, 427, 380, 436, 504, 506, 34 of the Indian Penal Code. Patna High Court Cr.Misc. No.56408 of 2018(3) dt.10-12-2018 2/3 submitted that the narration made in the F.I.R is absolutely incorrect. The occurrence is said to have taken place on 28.02.2018 but the report regarding the same has been lodged after nine days on 09.03.2018. Apart from this, during the course of investigation, it has come to light that the petitioners as well as the informant are the neighbours and there is a land dispute between them. The dispute actually pertains to a passage over which both the parties have staked their claim.
Considering the aforesaid facts as also taking into account that the investigation papers do not refer to any burnt article having been found at the place of occurrence, the petitioners, above named, in the event of their arrest or surrender within a period of four weeks from today before the learned Court below, are directed to be released on bail on their furnishing bail bonds of Rs. 10,000/-(Ten Thousands) each with two sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, Udakishunganj, Madhepura in connection with Chousa P.S. Case No. 54 of 2018,
