The petitioner seeks bail in a case registered under Sections 341, 323, 307, 379, 504 & 506/34 of the Indian Penal Code.
The prosecution case in short is that in the backdrop of land dispute, an altercation took place in between the parties and in consequence thereof, the accused persons started abusing the informant and also assaulted him, as a result of which, the informant sustained injuries.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 14-07-2019. Charge sheet has
Patna High Court CR. MISC. No.57350 of 2019(3) dt.14-10-2019 2/2 already been submitted. The nature of injury is said to be simple. Single iron rod blow is alleged to have been given. No repetition of blow is there. No offence u/S 307 of the Indian Penal Code is made out.
On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui in connection with Simultalla P.S. Case No. 30 of 2019.
