JUSTICE DINESH KUMAR SINGH ORAL ORDER 28-09-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341,323,324 and 308/34 of the Indian Penal Code.

The prosecution case is that the informant and his son were assaulted when they made protest for getting the tree of the informant cut by the petitioners.

It is submitted by the learned counsel for the petitioners that the injury of the informant and informant's son have been found to be simple though for one injury the opinion has been kept reserved. There is counter version of the occurrence also and the petitioners have also received injury. Statement has been made in

Patna High Court Cr.Misc. No.38704 of 2015 (2) dt.28-09-2015 2/2 paragraph 3 of the petition that the petitioners have no criminal antecedent.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Siwan in connection with Hussainganj P.S. Case No.145 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
