Petitioner is apprehending his arrest in connection with Dhansoi PS Case No. 64 of 2018 for the alleged offence under Sections 272, 273 of the Indian Penal Code and Sections 30(a), 35 and 38 of the Bihar Prohibition and Excise Act,2016. In the instant case, case diary was called for. On perusal of the case diary the learned APP submits that except that the petitioner is the owner of the Scorpio which was used in the instant case for carrying liquor there is no other material against the petitioner.

Learned counsel representing the petitioner submits that petitioner has no criminal antecedent.

Considering the aforesaid and also the fact that the petitioner has no criminal antecedent, this application is

Patna High Court Cr.Misc. No.60530 of 2018(3) dt.20-12-2018 2/2 allowed.

In the event of arrest or surrender before the concerned court below within a period of one month from today, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Addl. District Judge II-cum-Special Judge (Excise), Buxar in connection with Dhansoi PS Case No. 64/2018 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
