====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 22-09-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks regular bail in connection with Railway Patna Gaya Junction P.S. Case No. 390 of 2022 dated 02.10.2022, lodged under Sections 25(1-b)a, 26 & 35 of the Arms Act.

3. Learned counsel for the petitioner submits that vide order dated 10.05.2023 the bail application of petitioner was rejected with liberty to renew his prayer for bail after completion of ten months in custody.

4. Learned counsel for the petitioner further submits that petitioner is in custody since 02.10.2022 and today ten months has already been lapsed.

5. Learned counsel for the State opposes the prayer

Patna High Court CR. MISC. No.63586 of 2023(2) dt.22-09-2023 2/2 for bail but admits that ten months of custody has been completed.

6. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Gaya in connection with Railway Patna Gaya Junction P.S. Case No. 390 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C.

7. With this observation, the bail application stands allowed.
