JUSTICE SHAILENDRA SINGH ORAL ORDER 02-09-2025 By filing this writ application, the petitioners have prayed for the relief of the issuance of the writ in the nature of mandamus, directing the respondents to stop the construction of a government building over the land appertaining to Khata No. 414, Khesra No. 1529, area 5 decimals, situated in Mauza-

Patna High Court CWJC No.13945 of 2025(2) dt.02-09-2025 2/2 Surgahia of Bathnaha Circle of Sitamarhi District, which according to the petitioners has been under their continuous and peaceful possession for last 60 years.

2. In view of the nature of the aforesaid relief, this court finds that the petitioners have not made out a case for invoking the writ jurisdiction as specific and effective remedies are available to them under the civil laws which should have been availed, however, since the petitioners' representation dated 05.07.2025 is pending for redressal of their grievance, the District Magistrate, Sitamarhi is directed to decide the said representation at the earliest preferably within four weeks from the date of receipt or production of a copy of this order, by passing a reasoned order.
