JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-03-2015 Heard learned counsels for the petitioner and the State. The petitioners are languishing in jail since 26.08.2014 in a case registered for the offences punishable under Sections 341, 324, 307 and 379/34 of the Indian Penal Code and Section 3 (I) (X) of the SC/ST (Prevention of Atrocities) Act. It is alleged that the petitioners and two unknown came and caused firearm injury to the informant and snatched Rs. 10,000/- and mobile. The mobile and clothe of the informant were recovered from the possession of petitioner Ramesh Yadav. It is submitted by learned counsel for the petitioners that recovered mobile has not been put on T.I. Parade. Moreover, the accusation of firing is not specific against these petitioners, though two firearm injuries have been found on the person of the
Patna High Court Cr.Misc. No.42956 of 2014 (4) dt.03-03-2015 2/2 informant. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent.
Considering the aforesaid facts, let the above named petitioners be released on bail, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Saharsa in connection with Sour Bazar P.S.
