JUSTICE SUDHIR SINGH ORAL ORDER 08-10-2015 Heard learned counsel for the petitioner and learned counsel for the State The petitioner is languishing in custody since 04.05.2015 in connection with Paroo P.S. Case No. 74 of 2013 for the offences instituted under Sections 302/34 and 201 of the IPC. The prosecution story, in brief, is that the daughter of the informant Sindhu Devi was married to Ram Nath Thakur, S/O this petitioner Rajendra Thakur but after marriage she was assaulted and tortured over demand of dowry for which with the help of villagers Panchayati was also held but it did not impact her in-laws and in the meantime his son-in-law Ram Nath Thakur married to another woman and turned out his daughter after assaulting her and then he filed case in court which is still pending and in course
Patna High Court Cr.Misc. No.38698 of 2015 (3) dt.08-10-2015 2/3 of pendency of the case his son-in-law as per court's order brought her daughter from the court in the month of April 2013 to his house. It has been alleged that thereafter on 21.05.2013 the son-inlaw of the informant, his father, other family members, second wife's brother of the son-in-law of the informant and other relatives after killing her daughter burnt her dead body about which he got information on 22.05.2013 and after making enquiry in the village- Daudpur, village of the accused, he lodged the case. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. The petitioner is in custody since 04.05.2015 and the charge sheet has been submitted in the case. There is no allegation of tampering with the evidence against the petitioner. The marriage had taken place 12 years prior to the present occurrence. The petitioner is the father-in-law of the deceased. He is separate in mess and proper from the husband of the deceased.
On behalf of the State it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., (West),
