The petitioner seeks bail in connection with G.R.P. Patna P.S. Case No. 103 of 2016 for the offence punishable under sections 394 and 302 of the Indian Penal Code. It has been submitted on behalf of the petitioner that the petitioner is not named in the first information report and later on, on the basis of the statement of one Pramila Devi under section 164 Cr. P.C. the petitioner has been implicated in this case as it is alleged that the looted mobile was given to Pramila Devi by the petitioner. Apart from that there is no allegation against the petitioner and he has no criminal antecedent and is in custody for about seven months.

Heard learned A.P.P. also who has opposed the prayer

Patna High Court Cr.Misc. No.50221 of 2016 (3) dt.19-01-2017 2/2 for bail.

Having heard both sides and in view of the facts stated above and also considering the fact that there is nothing against the petitioner except the statement of Pramila Devi, who has stated that the looted mobile was given to her by this petitioner and the petitioner has no criminal antecedent and has remained in custody for about seven months, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned Railway Judicial Magistrate Patna in connection with G.R.P. Patna P.S. Case No. 103 of 2016 subject to the conditions that he will cooperate in disposal of the trial and shall make himself available on each and every date fixed in the case and on failure to appear on two consecutive dates, the petitioner will make himself liable for cancellation of bail bonds. With the above condition, prayer for bail of the petitioner is allowed.
