JUSTICE ARUN KUMAR ORAL ORDER 10-08-2017 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in connection with a case registered under Section 7 of the Essential Commodities Act. Allegation in brief is that the Block Supply Officer stopped the pick up van and found 70 bags of rice loaded but the driver and cleaner escaped away. It is suspected that these rice were lifted from a P.D.S. shop. The informant raided one P.D.S. shop and also the godown of the PACS of the petitioner and one Yogendra Singh present there and disclosed that the rice was loaded on the pick up van from the godown of the PACS. It is submitted that no shortage of rice was found form the godown rather it was in excess. Moreover, at the instance of Yogendra Singh, who is inimical to the petitioner as he earlier
Patna High Court Cr.Misc. No.37488 of 2017 (2) dt.10-08-2017 2/2 lodged a case against the petitioner under Section 302 of I.P.C. has falsely been implicated in this case, except that there is no material against him.
Having considered the said facts and circumstances, in the event of arrest/surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner, namely, Rajeev Kumar Vidyarthi be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M., Daudnagar, District- Aurangabad in connection with Goh P.S. Case No.81 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
