The petitioner seeks bail in Mahila P.S. Case No. 85 of 2021 corresponding to Sessions Trial No. 670 of 2021, registered for the offence punishable under Section 376 and other allied sections of the Indian Penal Code and sections 67, 67A of the Information Technology Act.

As per the prosecution case, this petitioner on the false pretext of marriage established physical relation with the informant and later on, refused to marry her. It is further alleged that he also assaulted the informant and took photographs and posted it on social media.

It is submitted on behalf of the petitioner that victim is a major girl and the relationship was consensual and only with a

Patna High Court CR. MISC. No.69050 of 2021(4) dt.25-04-2022 2/2 view to put pressure upon the petitioner to marry her this false case has been lodged by the informant. Petitioner is in custody since 26.07.2021.

Learned APP however, vehemently opposed the prayer for bail and submitted that victim in her statement under Section 164 Cr.P.C duly supported the prosecution case. In view of statement of victim girl/informant under Section 164 Cr.P.C, I am not inclined to enlarge the petitioner above-named on bail. Accordingly, the same is rejected.
