2. The petitioner seeks regular bail in connection with Chanpatia P.S. Case No. 304 of 2020, registered for the offences punishable under Sections 341, 323, 307, 385, 387, 504, 506 and 34 of the Indian Penal Code.
3. As per the prosecution case, the allegation against the petitioner is that, along with two other co-accused persons, he assaulted and threatened the informant for non-fulfillment of a demand of extortion of Rs. 1,00,000/-. It is alleged that all three named accused persons went to the informant's clinic, where co-accused Kundan put a towel around his neck, while co-accused Sameer and Ayush assaulted him with bamboo sticks
Patna High Court CR. MISC. No.56900 of 2025(2) dt.18-09-2025 2/2 causing injuries on his left hand, chest, waist and back. It is further alleged that co-accused Ayush pointed a katta at the informant and threatened to kill him.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated. Although the petitioner is alleged to have assaulted the informant, no specific injury has been attributed to him. The petitioner is in custody since 17.04.2025.
5. Learned A.P.P. for the State has vehemently opposed the prayer for bail.
6. Considering the fact that this case relates to demand of extortion from the informant and assault committed for the same by the accused persons including the petitioner, this application for regular bail stands rejected. (Sandeep Kumar, J) Neha/- U T
