====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 17-09-2024 Heard learned counsel for the petitioners and the State.

2. Petitioners apprehend arrest in a case registered for the offence punishable under sections 341, 323, 324, 325, 354, 307, 379/34 of the Indian Penal Code.

3. As per the prosecution case, all the FIR named accused persons including these petitioners abused and assaulted the informant by means of lathi, iron rod. Accused persons snatched mobile phone and gold chain of the informant.

4. It is submitted on behalf of the petitioners that the allegation of assault is against co-accused Md. Manan and no

Patna High Court CR. MISC. No.61722 of 2024(2) dt.17-09-2024 2/2 specific overt act has been alleged against these petitioners. Doctor has found simple injury. Petitioners claim clean antecedent.

5. Learned counsel for the State opposes the prayer for bail.

6. Considering the aforesaid facts of the case, prayer for bail of all the petitioners is allowed. In the event of arrest/surrender within eight weeks from today, let these petitioners, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st class, Vaishali at Hajipur in Rajapakar Police Station Case No. 83 of 2024, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
