Patna High Court Cr.Misc. No.40636 of 2015 (2) dt.01-10-2015 2/3 The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 379 and 504 of the Indian Penal Code.
The prosecution case is that petitioner no. 1 abused and assaulted the informant. In the meantime, petitioner no. 2 assaulted the informant with Farsa on his head as a result he sustained injury and petitioner no. 3 took out Rs.1100/- from the pocket of the informant.
It is submitted by learned counsel for the petitioners that the informant has received two lacerated injuries, simple in nature caused by hard and blunt substance whereas there is specific accusation that petitioner no. 2 to have assaulted with Farsa on the head of the informant. There is counter version of the occurrence and petitioners' side have also received injuries.
A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail
