This application, for grant of anticipatory bail, arises out of Mofassil Police Station Case No. 346 of 2016, disclosing offences under Sections 47(A) of the Bihar Excise (Amendment) Act. According to the prosecution case, apparatus for manufacturing wine and two litres wine was recovered from the house of the petitioner.
Learned Counsel for the petitioner has submitted that the petitioner has falsely been implicated in this case. The petitioner was not arrested on the spot at the time of raid rather the raid was conducted in his absence. The petitioner is a man of clean antecedent. Considering the facts and circumstances of the case and the nature of allegation, this Court court is not inclined to enlarge the
