The instant application for regular bail has been filed by the petitioner registered for the offence punishable under Sections 366A, 376/34 of the Indian Penal Code and Section 4 of the POCSO Act, Section 67a, 67B of the I.T. Act. As per allegation in the FIR, on the pretext of marriage, petitioner established physical relationship with the informant and also made a video of the incident. It is further alleged that when the petitioner went to Surat to earn his livelihood, he make the photo viral on social media. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. During trial, victim has not supported the prosecution
Patna High Court CR. MISC. No.59692 of 2023(2) dt.08-09-2023 2/2 case, which appears from deposition slip of the informant, which is annexed as Annexure-3 to the petition. Petitioner has got no criminal antecedent and languishing in judicial custody since 10.11.2022.
Learned APP appearing for the State has opposed the prayer of Bail.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Special Court pocso Act ADJ VI, Kaimur, Bhabua in connection with POCSO Case No. 02 of 2023 arising out of Mahila PS Case No. 36 of 2022.
