JUSTICE RAJESH KUMAR VERMA ORAL ORDER 15-12-2023 Heard Mr.Abhishek Kumar, learned counsel for the petitioners, learned counsel for the informant and Mr.Nawal Kishore Prasad, learned A.P.P. for the State.

2. The petitioners seek bail, who are in custody since 24.05.2022 in connection with S.Tr.No.1024 of 2022 arising out of Kesariya P.S. Case No. 207 of 2022, F.I.R. dated 13.05.2022 registered for the offence punishable under Sections 147,148,149,341,323,307,302,120(B) of the Indian Penal Code.

3. Earlier the bail petition of the petitioners has been dismissed as withdrawn vide order dated 09.05.2023 passed in Cr. Misc. No. 60792 of 2022. Thereafter the petitioners have moved before this Court for renewing their prayer for bail.

4. Vide order dated 08.09.2023, a report was called for

Patna High Court CR. MISC. No.59782 of 2023(4) dt.15-12-2023 2/2 with regard to the present status of the trial. Report of the learned Trial Court dated 16.09.2023 reveals that all the chargesheet witnesses have been examined and statement of the victim under Section 313 of Cr.P.C. has also been recorded by the learned Trial Court.

5. In view of the aforesaid, I am not inclined to enlarge the petitioners on bail in connection with S.Tr.No.1024 of 2022 arising out of Kesariya P.S. Case No. 207 of 2022 pending in the court of learned 11th Additional Sessions Judge, East Champaran, Motihari.

6. Prayer is refused.

7. However, the learned Trial Court is directed to expedite the trial and conclude the same at the earliest. (Rajesh Kumar Verma, J) Nitesh/- U T
