The petitioners seek anticipatory bail in a case instituted for the offences under Sections 147, 148, 149, 323, 341, 307 and 379 of the Indian Penal Code.
As per First Information Report all accused persons including the petitioners entered into the house of the informant and ordered him for giving divorce to his wife Bibi Rasina Khatoon and upon refusal by him to do so they assaulted the informant causing injury to him. Main allegation has been made against Shamim who has been granted bail by
Patna High Court Cr.Misc. No.33701 of 2017 (2) dt.25-07-2017 this Court vide Cr. Misc. No. 32657 of 2017.
Looking to the facts and circumstances of the case, in the event of arrest or surrender within four weeks from today, let petitioners, namely, Mojeeb, Shainaf, Rabeena and Afshana, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria in connection with Araria (Bairgachhi) P.S. Case No.721 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
