JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 21-07-2015 Heard Mr. Samdarshi for the petitioner and counsel for the respondent Nagar Panchayat.

The kind of dispute which has been raised in this writ application, in my view, cannot be decided while exercising the power of judicial review under Article 226 of the Constitution of India. The petitioner claims to have supplied the fogging machines of the specification which the petitioner-company offered. The respondent-Nager Panchayat has denied the aforesaid contention of the petitioner.

After some arguments, learned counsel submits that the

Patna High Court CWJC No.7662 of 2011 (7) dt.21-07-2015 2/2 petitioner may be granted liberty to ventilate the aforesaid grievance before the Municipal Commissioner, Gaya (respondent no.4).

The writ application is permitted to be withdrawn with the aforesaid liberty.

Needless to observe that if any such application/representation is filed, the said respondent shall consider the said grievance of the petitioner in accordance with law as quickly as possible.
