Petitioner apprehends his arrest in connection with Araria (Bairgachhi) PS case no. 721 of 2016 registered for the offences punishable under Sections 307 and other sections of Indian Penal Code.

It has been alleged that petitioner had come to the house of informant and pressurized him to divorce his wife and upon refusal by him to do so, the petitioner had assaulted the informant resulting injury to him.

Learned counsel for the petitioner submits that no injury report is on the record to suggest that any such incident had taken place, petitioner has got clean antecedents and has been falsely implicated in this case.

Patna High Court Cr.Misc. No.32657 of 2017 (2) dt.13-07-2017 2/2 Having regard to the facts and circumstances of the case, I deem it fit and appropriate to grant anticipatory bail to the petitioner.

Accordingly, let the abovenamed petitioner, in the event of his arrest or surrender in the Court below within a period of four weeks from today, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in connection with Araria (Bairgachhi) PS case no. 721 of 2016 subject to the conditions enumerated under Section 438(2) of Code of Criminal Procedure.
