2. The petitioner has preferred this application for grant of regular bail in connection with Jamui Cyber P.S. Case No. 27 of 2025 dated 04.07.2025 registered for the offences punishable u/ss 317(2), 319(2), 318(4), 336(2), 336(3) of the B.N.S. and Sections 66B and 66D of the I.T. Act.

3. As per the prosecution case, the informant received secret information, the petitioner is indulged in cyber fraud and for the verification of the same, the informant and the other police personnel reached the matrimonial house of the accused person then the petitioner tried to flee away from there but he was apprehended. On search, 5 mobiles were recovered from

The seized mobiles were brought to the police station and during the course of inquiry, it was found that illegal cyber activities were being carried out by the petitioner from these mobiles and further no sim was found in the name of the accused in the said mobiles. On being asked, the petitioner did not give any satisfactory explanation regarding the seized mobiles and he also did not produce any document regarding purchasing of the said mobiles.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner has been made accused in this case merely on suspicion. Nothing has been recovered from the conscious possession of the petitioner. It is further submitted that the recovery of mobiles has been made from the matrimonial house of the petitioner but the seized mobiles does not belong to the petitioner. The petitioner has no concern with the alleged offence. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 05.07.2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances

Patna High Court CR. MISC. No.57005 of 2025(2) dt.20-08-2025 3/3 of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Jamui in connection with Jamui Cyber P.S. Case No. 27 of 2025.

7. The application stands allowed.
