The petitioner seeks bail in a case registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code.

The informant named Surendra Rai @ Chikhari, Yogendra Rai, Neeraj Kumar Rai @ Budha, Birendra Rai and the petitioner and alleged that they all made indiscriminate firing on Mandita Kunwar. Mandita Kunwar got firearm injuries and she succumbed to the injuries during the course of treatment. It is submitted that similarly situated co-accused Yogendra Rai @ Yogendra Ram and Birendra Rai @ Birendra Ram have already been enlarged on bail vide orders passed in Cr. Misc. No. 1154 of 2015. Patna High Court Cr.Misc. No.39687 of 2015 (2) dt.01-09-2015 2/2 similar footing as five persons are alleged to have made firing, but only one firearm injury was found on the person of the deceased. Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur, Ara in Shahpur (Bahoranpur) P.S.
