Petitioners are not named in the first information report but they have been made in this case and the learned Additional Sessions Judge, Motihari while rejecting the prayer for bail of the petitioners vide impugned order dated 11.08.2015 mentioned that para-130 of the case diary contains material to show the involvement of the petitioners in the alleged crime but he did not mention what has come against these petitioners. It is submitted on behalf of the petitioners that except the confessional statement of co-accused as well as some criminal antecedent, there
Patna High Court Cr.Misc. No.47262 of 2016 (2) dt.09-12-2016 2/2 is nothing against the petitioners, who are languishing in jail custody since long and it is further submitted that moreover coaccused Nawab Thakur has already been granted privilege of by this Court.
Accordingly, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Sessions Judge XIth, East Champaran at Motihari in connection with Session case no. 352 of 2015 arising out of Rajepur P.S.Case No. 16 of 2014.
