The petitioner apprehends his arrest in Parsa Bazar P.S. Case No. 180/2018, registered for the offences punishable under Sections 498(A), 341, 323, 504 and 34 of the Indian Penal Code.

The wife of the petitioner made allegation that her husband, brother-in-law, mother-in-law, father-in-law and sisterin-law did not behave with her properly and they used to assault her each and every day. They also threatened to kill her. Learned counsel for the petitioner submits that the informant was married with the petitioner about 40 years ago, on account of land dispute the wife of petitioner lodged this

Patna High Court Cr.Misc. No.75659 of 2018(3) dt.11-01-2019 2/2 case. The informant wanted to partition the property of father of the petitioner and the father of petitioner does not want to part that property during his lifetime, that is why the informant lodged this case.

Considering the facts aforesaid and the fact that after 40 years of marriage the informant lodged this case for subjecting her to mental and physical torture, the petitioner above-named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Patna in connection with Parsa Bazar P.S. Case No. 180/2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J) vinita/- U T
