====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR JHA ORAL ORDER 19-11-2025 Heard learned counsel for the petitioners, learned counsel for the informant and learned A.P.P. for the State.
2. In the present case, the petitioners seek bail in connection with Basopatti P.S. Case No. 119 of 2025, registered for the offences under Sections 189(2), 126(2), 115(2), 118(1), 303(2), 109, 352, 351(2) of the BNS.
3. As per the prosecution case, petitioners and other co-accused persons assaulted the informant and his family members causing a number of injuries to them.
4. Learned counsel appearing on behalf of the petitioners submits that the petitioners are innocent and have been falsely implicated in this case. Learned counsel for the
Patna High Court CR. MISC. No.57630 of 2025(4) dt.19-11-2025 2/3 petitioners further submits that no occurrence in the manner as alleged has ever taken place and land dispute is admitted. Though there is allegation of assault against seven persons but there are no corroborative injuries. The injury of the informant is merely abrasion and simple in nature. Similarly, injury of other victims except Phul Kumar Singh is stated to be simple in nature and his injury is stated to be grievous due to fracture of nasal bone. One injury inflicted upon Punam Devi is stated to be dangerous to life which is an incised wound on right side of forehead. The petitioner no. 1 is having antecedent of one case whereas petitioner no. 2 is having antecedent of three cases. Petitioners are in custody since 20.05.2025 and charge sheet has been submitted.
5. Learned A.P.P. appearing for the State and learned counsel for the informant oppose the submission made on behalf of the petitioners. Learned counsel for the informant submits that the a number of persons received injuries in the assault by the petitioners and other co-accused persons.
6. Having regard to the fact and circumstances and submission made on behalf of the parties and considering the submission of charge sheet and period of custody of the petitioners, the petitioners are directed to be released on bail, on
Patna High Court CR. MISC. No.57630 of 2025(4) dt.19-11-2025 3/3 furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Madhubani/concerned court, in connection with Basopatti P.S. Case No. 119 of 2025, subject to the condition laid down under Section 480(3) of the BNSS and other following conditions:
(i) One of the bailors will be a close relative of the petitioners.
(ii) The petitioners will remain present on each and every date fixed by the below, if so required by the learned trial court.
(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioners will be liable to be cancelled by the court concerned.
