The petitioner is apprehending his arrest in connection with Tharthari P.S. Case No.96 of 2014 for allegedly having committed the offences under Sections 304B and 201/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is the father-in-law of the deceased. In connection with the present case, Trial No.613/14/Trial No.48/14 was concluded and in connection with Tharthari P.S. Case No.96 of 2014, learned Sessions Court has acquitted the accused persons and extended the benefit of doubt to Mukesh Yadav and Faresh Yadav, husband of the victim and his brother. Patna High Court Cr.Misc. No.43649 of 2014 (2) dt.20-03-2015 2/2 for the petitioner has also brought on the record the judgment of the aforementioned trial court and also the deposition of the informant, namely, Sanju Devi, who has also not supported the prosecution case.

Considering the aforementioned submissions and also the fact that the petitioner is the father-in-law of the deceased, let the above named petitioner, in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Camp Court, Hilsa, in connection with Tharthari P.S. Case No.96 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Anjana Mishra, J) PNM U T
