In view of the counter-affidavit filed by the Superintendent of Police, the Court is prima-facie satisfied that it was mistake committed on part of the Investigating Officer who kept the charge-sheet with himself and submitted it later only few days before the present order was communicated to the learned trial court.

Since the order granting bail was clear that petitioners shall remain on anticipatory bail till filing of chargesheet and now since charge-sheet has been submitted and the
