Learned counsel for the petitioners is permitted to withdraw the application with respect to petitioner no. 3 as he has been arrested.

The name of the petitioner no. 3 is deleted from the array of the parties.

Patna High Court CR. MISC. No.55720 of 2019(4) dt.16-11-2019 2/3 for the petitioners seeks permission to withdraw the application with respect to the petitioners no. 3, 4 and 5. Petitioner no. 3 has already been arrested therefore his application has become infructuous.

The applications of petitioners no. 4 and 5 have been withdrawn because of their criminal antecedents. The petitioners no. 1 and 2 seek bail in anticipation of their arrest in connection with Udwantnagar P.S. Case No. 243 of 2019 dated 26.06.2019 instituted for the offences under Sections 30 (A) and 30(D) of the Bihar Excise and Prohibition Act, 2016.

The petitioners no. 1 and 2 have been made accused in this case on the basis of confession of arrested co-accused persons.

There is no recovery from these petitioners and they have clean antecedents.

Considering the aforestated facts, the petitioners no. 1 and 2 viz. Ram Babu Singh and Hare

Patna High Court CR. MISC. No.55720 of 2019(4) dt.16-11-2019 3/3 Krishna Singh are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned learned 4th Additional Sessions Judge-cum-Special Judge, Excise, Bhojpur, Ara in connection with Udwantnagar P.S. Case No. 243 of 2019, subject to the conditions as laid down under Section 438(2) Cr.P.C.

With the aforesaid direction/observation, the petition stands disposed of.
