JUSTICE AKHILESH CHANDRA ORAL ORDER 21-01-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. This application has been filed for the grant of regular bail to the petitioner who is in custody for offences under Sections 302/201/34 of the Indian Penal Code, in connection with Kasba P.S. Case No. 91 of 2014 pending in the court of Judicial Magistrate, 1st Class, Purnea.

This case is instituted against unknown on recovery of the dead body of driver of the Tractor Trailer. Petitioner's name emerged during investigation while he was apprehended by the police during making an unsuccessful attempt to conceal the vehicle in question. Further, he appears admitting his guild, of

Patna High Court Cr.Misc. No.42699 of 2014 (3) dt.21-01-2015 course, before police but the manner stated above the death prima facie finds corroboration during autopsy. Having regard to the facts and circumstances, prayer for regular bail of the petitioner is refused. Simultaneously, court below is directed to proceed expeditiously and avoid undue delay and adjournment.
