The petitioner seeks bail in Sahpur P.S. Case No. 262 of 2017 registered under Sections 290, 295A and 190 of the Indian Penal Code and Section 4 of Prevention of Import of Animal and Cruelty Act, 1955.

Co-accused Shamshad was apprehended with 11⁄2 Kg beef who disclosed the name of the petitioner and four other accused persons as persons selling the same.

It is submitted by learned counsel for the petitioner that the petitioner has no concern with selling of beef. He has been falsely implicated in the case at the instance of his enemies. No incriminating article has been recovered from his conscious

Patna High Court Cr.Misc. No.15337 of 2018 (2) dt.19-03-2018 2/2 physical possession. There is nothing in the record indicating the complicity of the petitioner in the occurrence barring the disclosure of co-accused Shamshad. The petitioner has been languishing in custody since 05.12.2017.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-XIV, Bhojpur, Ara in connection with Sahpur P.S.
