2. The petitioner has preferred this application for grant of regular bail in connection with Gogri P.S. Case No. 50 of 2025 dated 26.02.2025 arising out of G.R. No. 4556/2025 registered for the offences punishable u/ss 126(2), 109, 308(5) and 352 of the B.N.S. and Section 27 of the Arms Act.

3. As per the prosecution case, the informant alleged that Rs. 2 lacs as extortion money was demanded from the informant's husband by the petitioner and when the informant's husband objected the same, he was shot fired in his left palm and also in right hand in the presence of the informant. After

Patna High Court CR. MISC. No.56979 of 2025(2) dt.20-08-2025 2/3 hearing the sound of firing, the informant's sons came there and tried to caught the petitioner but he succeeded to flee away.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. Learned counsel has further submitted that as per the injury report of the informant's husband, the injury is stated to be grievous in nature caused by firearm but it is on non-vital part of the body. The petitioner has no concern with the alleged offence. The petitioner has two criminal antecedents as stated in para 3 of the bail petition. The petitioner is in custody since 04.06.2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Khagaria in connection with Gogri P.S. Case No. 50 of 2025, G.R. No. 4556/2025, with the condition :- (i) The petitioner is directed to remain physically present before the learned

Patna High Court CR. MISC. No.56979 of 2025(2) dt.20-08-2025 3/3 Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.

(ii) If the petitioner is found involved in similar nature of offence in future, the prosecution will be at liberty to move for cancellation of his bail bonds.
