2. The petitioner seeks bail in a case registered for the offence punishable under Sections 302 and 120B of the Indian Penal Code and Section 27 of the Arms Act.

3. As per prosecution case, it is alleged that on 31.08.2001 at about 4:15 AM, on account of love affair, all the accused persons abused and killed the son of informant.

4. It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. Informant is not an eye witness of the occurrence. Petitioner is not named in the F.I.R.. Name of petitioner transpired in this

Patna High Court CR. MISC. No.58656 of 2025(3) dt.03-11-2025 2/3 case during course of investigation only on the basis of confessional statement of co-accused person. Save and except confessional statement, there is no material on record to show the complicity of this petitioner in the alleged occurrence. Moreover, charge-sheet has already been submitted and petitioner is in custody since 15.07.2025. Petitioner has got no criminal antecedents.

On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner and submitted that this petitioner, along with other F.I.R. named accused persons, committed murder of son of informant. During course of investigation, sufficient material has come to show the complicity of this petitioner in the offence. It is further submitted that the petitioner remained an absconder for about 24 years and thus, delayed the trial.

6. Considering the facts and circumstances of the case, gravity of offence and conduct of the petitioner, the prayer for grant bail of to the petitioner is rejected.

7. However, considering the fact that the petitioner is in custody since 15.07.2025, the learned trial court is directed to expedite the trial and conclude the same preferably within a period of one year from the date of receipt/production of a copy
