27-10-2016 Heard Sri Vikramdeo Singh, learned counsel assisted by Sri Sadanand Roy, learned counsel for the petitioner and Sri Madan Kumar, learned APP.

The sole petitioner, who is in custody in Mohania P.S. Case No. 317 of 2016 registered for offence under Sections 457, 354, 354(A)(2), 34 of the Indian Penal Code, has prayed for grant of bail.

It was argued by learned counsel for the petitioner that on perusal of F.I.R., it is evident that petitioner has falsely been implicated. He submits that if allegation, as per F.I.R., is accepted as true, there was no reason to prevent the petitioner to commit further offence, even then, the case was lodge under

Patna High Court Cr.Misc. No.45748 of 2016 (2) dt.27-10-2016 2/2 Section 354(A) of the Indian Penal Code.

After perusing the F.I.R. and nature of accusation, I am not inclined to grant bail.

Dismissed.
