The petitioner is in custody in Motihari Town P.S. Case No.480/13 registered for the offence under Sections 457, 380 and 411 of the I.P.C.

Learned counsel for the petitioner submits that earlier the prayer for bail of the petitioner was refused by this Court on merit vide Cr. Misc. No.9169/16 on 29.03.2016 as one looted motor cycle is said to be recovered from the courtyard of the petitioner. Petitioner is in custody in the present case since 20.12.2013 and till today charge has not yet been framed. Having considered the facts and circumstances of

No.45843 of 2016 (3) dt.08-02-2017 2/2 the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the C.J.M., Motihari, in Motihari Town P.S. Case No.480/13 with condition that one of the bailors must be his close relative who will file affidavit that the petitioner will appear on each and every date of the trial and, if he fails to do so on two consecutive dates, the trial court will be at liberty to cancel his bail bond.
