The petitioner apprehends his arrest in connection with Manpur P.S. Case No. 13 of 2019, registered under Sections 332, 333, 353, 323, 504, 307 and 427 of the Indian Penal Code and Section 30(a) of the Bihar Excise Act. The accusation is of recovery of five litres country made liquor, kept in a container, from the house of the petitioner.

Learned counsel for the petitioner submits that while it is alleged in the F.I.R. that five litres country made liquor was recovered from the house of the petitioner but it would appear from the seizure list that neither petitioner nor his

Patna High Court CR. MISC. No.53759 of 2019(2) dt.27-08-2019 2/2 family members has been made witness in the seizure list and the copy of the seizure list has also not been served to the family members of the petitioner and petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Bettiah, West Champaran, in connection with Manpur P.S. Case No. 13 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
