JUSTICE ANIL KUMAR UPADHYAY ORAL JUDGMENT (Per: HONOURABLE THE CHIEF JUSTICE) Date : 13-09-2017 The averments made in para 7 of the supplementary counter affidavit filed by respondent Nos.2 and 3reads as under: "7. That nevertheless, it has been decided in principle to post a Haematologist in the Gardinar Road Hospital. In this regard the department has decided to create two posts of Haematologist, one for New Gardiner Road Hospital and another for PMCH. The necessary procedure requirements are being fulfilled which may take six weeks. However, keeping in view the interest of the common people, Dr. Subhash Chandra Jha, Asstt. Professor, Govt. Medical College, Bettiah, who is
Patna High Court CWJC No.13743 of 2015 dt.13-09-2017 2/2 MD, Pathology and has already done training in Haematology has been deputed in the Gardinar Road Hospital vide memo no-506(17), dt. 29-82017 issued by the Special Secretary to the Govt." In view of the above, we dispose of the matter with a direction to the State Government to continue with the arrangement made till regular Haematologist is appointed in the hospital in question. The process of appointment of a regular Haematologist be undertaken and it be concluded, preferably within a period of six months from the date of receipt/production of a copy of this order.
Needless to emphasize that till regular appointment is made, the arrangement which has now been indicated should continue to be operational.
