JUSTICE RAKESH KUMAR ORAL ORDER 16-12-2016 Heard Sri Nagendra Kumar Singh, learned counsel for the petitioner and Sri Ravindra Kumar Sharma, learned Central Government Counsel.
The sole petitioner, who is in custody since 28.05.2014 in C2A 01/2014 registered for the offence under Sections 8, 20,25 and 29 of the N.D.P.S.Act , has prayed for grant of bail.
It was submitted by learned counsel for the petitioner that the petitioner was only Khalasi on the truck, from which about 213 kg of Ganja was recovered. It has been argued that the driver, who was owner of the vehicle, was arrested along with the petitioner and the petitioner was not knowing regarding
Patna High Court Cr.Misc. No.45329 of 2016 (2) dt.16-12-2016 2/2 concealment of Ganja.
Considering the recovery of huge quantity of Ganja from the truck, I am not inclined to extend the privilege of bail to the petitioner. However, since the petitioner is in custody since 28.05.2014, while dismissing the present petition, it is desirable to observe that the learned court below as well as the prosecution may take all steps so that the case may come to its logical end without unnecessary delay.
